Escaping from detention or jail is a felony if the person is escaping from jail, or charged with a felony.  It is a felony in the second degree, if the escaping party causes bodily injury to another in order to escape.  If seriously bodily injury is caused, then it is a first degree felony.  Texas Penal Code, Section 38.06.
