What is Arson?
Arson is the intentional starting of a fire to cause damage to property.
Starting a fire to anything is a state jail felony unless a person is injured by the fire, in which case the act is a third degree felony (up to 10 years prison). Texas Penal Code 28.02. Arson is a felony. A person commits an offense if the person starts a fire, regardless of whether the fire continues after ignition, or causes an explosion with intent to destroy or damage.
A lesser offense from arson could be criminal mischief or reckless damage.
